תנאי שימוש Funzy World

ברוכים הבאים ל- Funzy World  הבית המקוון שלכם למעריצים מושבעים, בו סלבריטאים ומעריציהם יכולים ליצור אינטראקציה בדרך החדשנית ביותר. 

אנו שמחים להיות הפלטפורמה שלכם שמקשרת אתכם ומעריצים אחרים עם אמנים, מבצעים, אייקוני מדיה חברתית וסלבריטאים שונים ("אמנים") כדי שתוכלו ליצור אינטראקציה באמצעות האתר או ישירות איתם. 

אנא קראו את כל תנאי השימוש הללו בעיון, מכיוון שהם מכילים מידע משפטי חשוב הנוגע לזכויותיכם, חובותיכם, היקף הסעדים וכו', אשר תחויבו בהם כהסכם משפטי. 

כל שימוש מכל סוג שהוא באתר, בכל אפליקציה, בכל צלמית או סחורה אחרת או בכל אחד משירותיהם (כולל יצירת אינטראקציות סלבריטאים מכל הסוגים) יהווה הסכמה לתנאים אלה. 

אנא אל תעשו דבר מהאמור לעיל אלא אם אתם מסכימים לתנאים כפי שהם מוגדרים כאן. 

בתנאים אלה, המונח "האתר" (או "אנו", "שלנו") מתייחס לאתר האינטרנט בכתובת https://funzy.world, לכל אפליקציה קשורה—לרבות אך לא מוגבל לאפליקציית Funzy ואפליקציית Funzy - Eyal Golan —ולכל שירות נלווה. הגדרה זו כוללת, לפי העניין, גם את בעלי האתר, הגופים המנהלים, המפעילים, הדירקטורים, העובדים, בעלי המניות, החברות הקשורות וכל נציג מוסמך אחר.

שינויים בתנאים  :עליכם לבדוק את התנאים (כהגדרתם להלן) מעת לעת לאיתור שינויים. 

אנו עשויים לשנות את התנאים מעת לעת ללא הודעה מוקדמת. 

אם נבצע שינויים מהותיים בתנאים, נפרסם את התנאים המתוקנים ואת תאריך התוקף שלהם באתר או נודיע לכם באמצעות דואר אלקטרוני, אך ייתכן שלא נעשה זאת לפי שיקול דעתנו. 

כל שימוש מתמשך על ידכם באתר (כולל כל האפליקציות או השירותים שלהן) לאחר פרסום תנאים מתוקנים כאמור ייחשב כהסכמה מפורשת שלכם לתנאים המתוקנים כאמור. 

בהתאם לכך, אם בכל עת אינכם מסכימים להיות כפופים לתנאים מתוקנים כלשהם, עליכם להפסיק להשתמש בשירות או באתר. 

מטרתנו

  • האתר והשירותים שלנו נועדו לאפשר לכם ולמעריצים אחרים לעקוב אחר האמנים האהובים עליכם, ליצור איתם אינטראקציה, לקבל מהם תכנים ומוצרים שונים, להשתתף בפעילויות המקוונות והלא מקוונות שלהם וכו'. לכן אנו מספקים לאמנים שתבחרו לעקוב אחריהם נתונים ומידע שונים עליכם ומנסים לאפשר אינטראקציות וקשרים פתוחים, ישירים ומהנים בין האמנים לבינכם. 
  • לאחר שתחיל אינטראקציה כזו, האמנים ואתם רשאים לקיים אינטראקציה באמצעות האתר או מחוצה לו, הכל כפי שתבחרו לנכון.  אנו לא לוקחים חלק באינטראקציה כזו, אלא אם צוין אחרת במפורש באתר. 

התנאים ותוקף

  • התנאים. תנאים אלה, מדיניות הפרטיות https://www.funzy.world/privacy-policy  של האתר וכל מדיניות, הנחיות או תנאים אחרים המתפרסמים על ידי האתר או חלים על כל אפליקציה, שירות, הזמנה או רכישה, ביחד או בנפרד, לפי העניין, להלן - "התנאים" .

  • התנאים יישארו בתוקף מלא בכל עת כל עוד הם רלוונטיים.  סגירת חשבונכם אינה מפסיקה את תחולת התנאים עליכם.

  • השימוש באתר על ידי אנשים מתחת לגיל 16 אסור . בהתאם לכך, ילדים מתחת לגיל 16 אינם רשאים להשתמש באתר לרכישות, ואם יעשו זאת - השימוש שלהם עשוי להיות אסור ומוגבל ללא הודעה מוקדמת.

הרשמה לאתר

  • השירותים שלנו עשויים להיות חינמיים או לא חינמיים.  אנו רשאים, בכל עת ובנוגע לכל שירות או מוצר, להחליט אם שירות או מוצר כאמור הם ללא תשלום או אינם ללא תשלום.  החלטה כזו עשויה להשתנות מעת לעת.
  • הדמויות והאינטראקציות . אנו עשויים להשתמש (למכור) צלמיות או חפצים אחרים (כולם וכל אחד מהם להלן - "הצלמיות") כדי לאפשר לכם הרשמה ישירה ומהירה לאתר.  מטרתם היחידה היא לאפשר אינטראקציה ישירה יותר ביניכם לבין ידועניכם האהובים, אמנים.  אתם רשאים להשתמש בצלמיות כאמור כדי לקבל תוכן אישי או אחר וליצור אינטראקציה עם האמנים האהובים עליכם.  חלק מהתכנים וההצעות של האמנים עשויים להיות פומביים ואחרים מותאמים אישית למעריציהם או לכם ספציפית.  האמנים עצמם הם אלה שמנהלים את מערכות היחסים שלהם, והאתר הוא פשוט פלטפורמה המאפשרת אינטראקציות אלה (ואינו שולט בהן). 
  • הרשמה לאתר. כדי לעקוב אחר אמן, לקבל ולצפות בתכנים שלה או ליצור איתה ועם הצוות שלה אינטראקציה, ייתכן שתידרשו להשתמש ב"צלמית הסלבריטי" שהשגתם ולפתוח חשבון משלכם.  אתם רשאים לחבר צלמיות שונות לחשבונכם, אחת לכל אמן שתרצו לעקוב אחריו וליצור איתו אינטראקציה.
    כדי להסיר ספק, במקרים שונים ההרשמה לאתר תתאפשר ללא שימוש בצלמית (או למשל באמצעות שימוש בקוד רלוונטי במקום זאת), אך כל התנאים המפורטים כאן חלים גם על הרשמה כאמור.  מעקב אחר אמן יתבצע ישירות על פי בחירתכם, במקרים כאלה.

  • עם ההרשמה תתבקשו לבחור שם משתמש ייחודי וסיסמה אישית (אשר יישארו מוצפנים ולא יהיו זמינים לנו).  ייתכן שתתבקשו גם להזין נתונים שונים שישמשו אותנו בעת ניהול ההנאה שלכם מהאתר וישותפו עם אמנים שונים שאתם עוקבים אחריהם . עם רישום חשבונכם, אתם מסכימים:   
    • שאתם מבינים שכל מה שאתם מעלים או משתפים בחשבונכם עשוי להיות משותף עם האתר והאמנים הרלוונטיים שאתם עשויים לעקוב אחריהם והצוות שלהם.  כל דבר שאתם מפרסמים בכל פורום ציבורי עשוי להיות גלוי לכל משתמש באתר;

    • כי מסירת מידע כאמור אינה חובה, היא בהתאם להסכמתכם ורצונכם, וכי האתר והאמנים רשאים להשתמש בכל מידע כאמור כדי לקדם את האתר, את האמן או את האינטראקציות שלכם איתם;

    • שהמידע שתספקו לאתר או לאמנים יהיה עדכני, שלם ומדויק;

    • שלא תצלמו צילומי מסך או הקלטות אחרות של חומרים ותכנים ויצירות שאתם מקבלים מהאתר.  תכנים ויצירות כאמור עשויים להיות מוגנים בזכויות יוצרים ואתם מחזיקים ברישיון הלא בלעדי והניתן לביטול לצפות באופן פרטי בכל תוכן ויצירה כאמור.  אין רישיון לשימוש אחר. כל שימוש לא מורשה בתכנים או ביצירות כלשהם (מהאתר או מהאמנים ישירות) יביא לסיום אוטומטי של הרישיון שלכם;

    • לא להעביר, למכור, להמחות או לשעבד את הזכות להשתמש בחשבונכם לצד שלישי כלשהו; 
    • לא לאפשר לכל צד שלישי להשתמש בשם המשתמש ובסיסמה שלכם או בצלמית שלכם כדי לגשת לחשבונכם.  אתם מסכימים עוד כי אתם אחראים להתנהלות של כל צד המשתמש בחשבונכם או בצלמית שלכם, בין אם הורשתם זאת ובין אם לאו, ולכל הפרת אבטחה הקשורה לכך.

  • כל פעילות בחשבונכם, בדמות FUNZY שלכם ובפרטים שלכם היא באחריותכם הבלעדית. בדקו היטב כל פרט שאתם מוסרים לאתר, מכיוון שהאתר יפעל על פיהם. מידע שגוי, מיושן, לא שלם או שגוי עלול לגרום לתוצאות לא רצויות. כמו כן, שימוש בצלמית שלכם על ידי צד שלישי עלול לפגוע בפרטיותכם, בהנאתכם מהאתר או באינטראקציה עם האמנים שתבחרו לעקוב אחריהם. אתם מתבקשים לשמור על הסיסמה, הצלמית וכל מידע פרטי אחר בסודיות, מכיוון שאתם תהיו האחראים הבלעדיים לכל דבר שיקרה בחשבונכם, גם אם לא בוצע על ידכם.

  • ההרשמה עשויה להידחות. האתר שומר לעצמו את הזכות, אך אינו מחויב או מצהיר, לבדוק כל אחת ואחת מבקשות הרישום ולדחות כל אחת מבקשות אלה בכפוף לשיקול דעתו הבלעדי וללא מתן הסבר או הודעה. אם אינכם מסכימים, אנא אל תירשמו לאתר. במקרים מסוימים, האתר עשוי שלא לאפשר רישום או רכישה ספציפיים על פי שיקול דעתו הבלעדי וללא מתן הסבר. לא תהיה לכם כל תלונה או תביעה נגד האתר במקרה כזה.

  • מתן זכויות. עם ההרשמה (ובכפוף לשימוש מקובל או נאות בצלמית ובממשק האתר) האתר מעניק לכם זכות מוגבלת, הניתנת לביטול, בלתי ניתנת להעברה, לא בלעדית לגשת ולהשתמש באתר, אם פעילות זו היא אך ורק למטרותיכם האישיות.

  • סיסמה והדמות FUNZY הן פרטיות וחייבות להישמר כך. באחריותכם לשמור על הסיסמה והצלמית שלכם פרטיות וסודיות (לפי העניין). כל שימוש או שימוש לרעה בסיסמה או בצלמית שלכם יהיו באחריותכם הבלעדית.

אם אתם חושדים בשימוש לא מורשה בחשבונכם, אנא הודיעו לנו מיד (בדף "צור קשר" שלנו https://www.funzy.world/contact (נושא: שימוש לא מורשה בחשבון שלי), וספקו לנו מידע מספיק הן כדי לבסס את חשדכם והן את בעלותכם על החשבון לפי שיקול דעתנו. אנא שנו גם את הסיסמה שלכם מיד.

שימוש באתר ובדמות FUNZY

  • שימוש בדמות FUNZY. כל צלמית שתוכלו לקבל מוטבעת ברכיב NFC שהאתר (כולל האפליקציה שלו) עשוי לזהות ולהקצות ישירות לחשבונכם האישי. שימוש כזה עשוי להקל עליכם להירשם לאתר או לאמנים ספציפיים.

  • שימוש באתר. לאחר שתשתמשו בצלמית ותפתחו חשבון, האתר ישתמש בצלמית הרלוונטית של כל אמן כאינדיקציה לכך שאתם מעוניינים לעקוב אחר אותו אמן, לקבל וליהנות מחומרים שאמן זה מפרסם באתר, לקרוא פוסטים רלוונטיים, לצפות בקטעי וידאו רלוונטיים, להשתתף בחידונים, להירשם להופעות ומופעים שונים ולהיחשף לכל פעילות שהאמן הרלוונטי עשוי לאפשר באתר. בשל מטרתנו העיקרית, אנו מספקים לכל אמן שתוכלו לעקוב אחריו את המידע שאתם מעלים לאתר, או שהאתר אסף עליכם, ככל שיהיה רלוונטי.

האתר עשוי לאפשר לכם פעילויות, תכנים ואינטראקציות שונות, כגון (אך לא רק) כתיבה בפורומים שונים, קבלת תכנים והצעות שונות, צפייה בסרטונים מיוחדים והשתתפות בפעילויות ייחודיות שהאמנים יוצרים.

  • הרישיון המוענק לכם.  אנו מעניקים לכם בזאת רישיון לא בלעדי, בלתי ניתן להעברה (המוגבל על ידי התנאים) לגשת ולהשתמש באתר בהתאם לשימוש רגיל בממשק שלו. כדי להסיר ספק, השימוש באתר הוא ברישיון, לא במכירה.

  • אינכם רשאים: במידה המרבית המותרת על פי החוק החל, אינכם רשאים, ואינכם רשאים לאפשר לאדם או לגורם אחר כלשהו:


    • להעמיד לרשות הציבור, לשדר, לבצע או להפיץ בכל דרך שהיא (מסחרית או פרטית, בתשלום או בחינם) כל תוכן או יצירות כלשהם באתר או שנמסרו לכם מטעם מי מהאמנים;

  • לתת רישיון משנה, להפיץ מחדש או להחכיר כל חלק מהאתר, את חשבונכם בו או כל תוכן הכלול באתר או מסופק על ידי אמן כלשהו;

  • לבצע הנדסה לאחור, להדר לאחור, לפרק, לשנות, לתרגם, לנסות לגלות את קוד המקור של האתר או ליצור יצירות נגזרות מכל השירותים או הסקרים;

‍

  • להעתיק, לשכפל, להעתיק, למכור, לסחור, למכור מחדש או לנצל לכל מטרה מסחרית כל שימוש או גישה לאתר; או

‍

  • להעתיק, לשכפל, לצלם, לאחסן, לשדר מחדש, להפיץ או לעשות כל שימוש שאינו בהתאם לממשק האתר או תוך הסרת הלוגו של האתר, בכל תוכן הכלול בו.

  • התנהגות אסורה. להלן רשימה לא ממצה של סוגי ההתנהגות האסורים באתר, כולל התנהגות שהיא –

  1. שימוש בלתי חוקי או לא מורשה באתר, כולל אך לא רק הפרת קניין רוחני וכל פעילות בלתי חוקית, מפרה, מזיקה, פוגענית או בלתי הולמת אחרת;
  2. הטרדה, מעקב או הסתה להטרדה או מעקב של אדם אחר או קבוצת אנשים;
  3. דרישת סיסמאות או מידע אישי אחר (כגון כתובות, מספרי תעודת זהות וכו') ממשתמשים אחרים;
  4. ניסיון להתחזות לאדם אחר או פתיחת חשבון בשם בדוי, מאפיינים או מצגים כוזבים;
  5. שימוש בחשבון, בשם משתמש, בצלמית או בסיסמה של אחר בכל עת או חשיפת הסיסמה שלכם לכל צד שלישי או מתן אפשרות לכל צד שלישי לגשת לחשבונכם או לצלמית שלכם;
  6. גישה לנתונים או לקוד שאינם מיועדים למשתמשי האתר, או השגת גישה לא מורשית לחשבון, לצלמית, לשרת או לכל מערכת מחשבים אחרת;
  7. ניסיון לבדוק, לסרוק או לבחון את הפגיעות של מערכת או רשת או להפר אמצעי אבטחה או אימות;
  8. כל שימוש או גישה אוטומטיים לאתר (או לכל קוד או צלמית), כולל אך לא רק "בוטים", "רובוטים", "עכבישים" וכו' הניגשים לאתר באופן השולח הודעות בקשה לשרתי האתר יותר ממה שאדם יכול להפיק באופן סביר באותה תקופה באמצעות שימוש בדפדפן מקוון רגיל.
  9. ניסיון או הפרעה לתפקוד האתר, השירות, המארח או הרשת, לרבות, ללא הגבלה, באמצעות שליחת וירוס לאתר או למשתמשיו, עומס יתר, "הצפה", "הפצצת דואר", "קריסה", "התקפות די-דוס", "תוכנות זדוניות" או שליחת דואר אלקטרוני לא רצוי, לרבות קידום מכירות ו/או פרסום של מוצרים או שירותים;
  10. עקיפה, השבתה או הפרעה בדרך אחרת לתכונות הקשורות לאבטחה או לתכונות אחרות של ניהול זכויות דיגיטליות של האתר.

  • אינכם רשאים לשנות או לשנות בשום צורה או אופן כל חלק מהאתר, את המראה והתחושה שלו, הממשק, הפרסומות, הקוד, התדפיסים, התוכן, היצירות הכלולות או כל אחת מהטכנולוגיות הקשורות אליו או הסקרים בתוכו.

  • כדי להסיר ספק, איננו מתחייבים לשמור גיבוי כלשהו או לאפשר גישה חופשית ורציפה לכל תוכן או יצירה הכלולים באתר או מסופקים על ידי האמנים (כולל כרטיסים להופעות). אתם מתבקשים להוריד או לשמור עותק לכל תוכן כאמור שאינכם רוצים לאבד (למעט יצירות מוגנות, שאליהן תוכלו לפעול בהתאם לחוק).

זכויות קנייניות וקניין רוחני

  • זכויות יוצרים של האתר.  האתר הוא וכולל יצירות המוגנות בזכויות יוצרים וסימנים מסחריים מוגנים. אינכם רשאים לשנות, להפיץ, להעתיק, למסגר, לפרסם מחדש, להציג, לפרסם, לשכפל, למכור או לעשות כל שימוש אחר בכל דרך שהיא בכל תוכן או חלק מהאתר או בכל סימן מסחרי בו.

  • יצירות ותוכן של אמנים והגבלת רישיון. האתר עשוי לכלול, או שאתם עשויים לקבל או להיחשף, לתכנים ויצירות מוגנות שונות (להלן: "יצירות"). זכויות היוצרים ביצירות האמורות מוחזקות על ידי צדדים שלישיים, כגון אמנים או אחרים שונים. תקבלו גישה ליצירות האמורות כחבר מוערך באתר או כמחזיק בצלמית רלוונטית. עם זאת, ברצוננו לציין במפורש שגישה כאמור מעניקה רישיון מוגבל, לא בלעדי, ניתן לביטול בלבד ואינכם רשאים לעשות כל שימוש ביצירות האמורות למעט הנאה אישית.

תוכן, יצירות ואינטראקציות של אמנים

  • מידע ישותף עם אמנים. המטרה העיקרית של האתר היא לאפשר קישוריות ואינטראקציות ישירות ישירות ביניכם, בין אמנים נבחרים לבין הצוות שלהם. מסיבה זו, כל המידע שנמסר לנו עשוי להיות משותף גם עם האמן הנבחר שלכם.
  • אמנים משתמשים במידע ללא שליטת האתר. מוסכם במפורש כי לאחר שהמידע שלכם מסופק לכל אמן ולצוות שלו, כל שימוש במידע כאמור וכל פעילות או אינטראקציה עם אמן כאמור אינם נשלטים על ידי האתר. האחריות והחבות הבלעדיות הנוגעות לכל פעילות כאמור הן בידי האמן הרלוונטי או כל מי שפועל מטעמו.

תוכן שנוצר על ידי משתמשים

  • תוכן משתמש.  אתם מצהירים ומתחייבים כי אתם הבעלים של כל הזכויות בתוכן כלשהו (כגון הודעות, תמונות, סרטונים, טקסט ותוכן או יצירות אחרות) שהועלה על ידכם לאתר או לשירותיו, לרבות עיצובים, תמונות, הנפשות, סרטונים, קבצי שמע, גופנים, לוגו, איורים, קומפוזיציות, יצירות אמנות, ממשקים, טקסט, יצירות ספרותיות, יצירות מוזיקליות וכל חומרים אחרים ("תוכן משתמש"), או שיש לכם (ויהיה לכם) הכוח, הבעלות, הרישיונות, ההסכמות והסמכות המלאים, בתוכן המשתמש שלכם, כנדרש כדי להשתמש, לפרסם, להעביר או לתת רישיון באופן חוקי לכל הזכויות והאינטרסים בתוכן משתמש כאמור.
  • תוכן המשתמש הוא (ויהיה) אמיתי, עדכני, מדויק, לא מפר זכויות של צד שלישי כלשהו, ובשום אופן אינו בלתי חוקי עבורכם להחזיק, לפרסם, לשדר או להציג.

  • איננו מתחייבים לבדוק ולסרוק תוכן משתמש כאמור ואתם נושאים באחריות הבלעדית לכל תוכן משתמש כאמור.

  • השגתם את כל ההסכמות והאישורים הנדרשים על פי כל החוקים החלים, בנוגע לפרסום, שידור ופרסום של כל מידע אישי ו/או תמונה או דמות של כל אדם, ישות או רכוש שהם חלק מתוכן המשתמש, ותקפידו על כל החוקים החלים על כך.

  • אתם מאפשרים עוד לאתר ולכל מי מטעמו רישיון חופשי, בלתי מוגבל, לא בלעדי להשתמש בכל תוכן משתמש כאמור באתר, על ידי האמן או לצורך הפצה ושיווק של האתר.

סיום התקשרות

  • סיום של חשבונות ספציפיים.  האתר רשאי לסיים כל חשבון או חברות, למחוק כל פרופיל ו/או לאסור על כל משתמש להשתמש או לגשת לאתר או לכל רכישה בתוכו, כולו או חלק ממנו, מכל סיבה שהיא, ללא סיבה, בכל עת לפי שיקול דעתו הבלעדי, עם או בלי הודעה מוקדמת.

  • סיום האתר או כל אחד משירותיו.  האתר רשאי גם לסיים את פעילותו, כולה או כל חלק ממנה (כולל כל אחד משירותיו או הצלמיות שלו), לצמיתות או זמנית לפי שיקול דעתו. האתר אינו מנפיק אחריות כלשהי להמשך קיומם של כל השירותים או המוצרים ורשאי לסיים את כולם או כל אחד מהם לפי שיקול דעתו, ללא הודעה מוקדמת ובכל עת.

  • אין סעדים עם סיום התקשרות.  כדי להסיר ספק, לא יוענק לכם כל סעד מכל סוג שהוא אם האתר סיים את חשבונכם, את הצלמית שלכם, כל אחד משירותיו או את פעילותו כליל ואין לכם כל תביעה נגד האתר באף אחד ממקרים אלה.

כרטיסי אשראי ואמצעי תשלום אחרים

  • כל תשלום לאתר או לכל אחד מהאמנים בתוך האתר, מתבצע על ידי ולשירותי עיבוד תשלומים של צדדים שלישיים (כגון תשלומים של Apple או Google וכו'. לפני שתמשיכו לתשלום, אנא עיינו במדיניות הפרטיות האישית שלהם (כפי שמופיעה ליד תיבת התשלום), בתנאי התשלום שלהם ובאמצעי התשלום שלהם. אנא לעולם אל תשתמשו בכזה שאתם לא מרגישים איתו בנוח או מסכימים לו. אנו (האתר) לא נהיה אחראים לפעולות ולמדיניות של צדדים שלישיים כאמור.

  • פרטי כרטיס האשראי שלכם אינם משותפים איתנו.

  • אנא הקפידו למסור את הפרטים המדויקים של אמצעי התשלום שלכם ואת כתובת החיוב ומספר הטלפון המדויקים שלכם (כלומר, הכתובת ומספר הטלפון שמופיעים בבנק כרטיס האשראי שלכם). מידע שגוי יגרום לעיכוב בעיבוד ההזמנה שלכם ועלול שלא לאפשר לנו לעבד אותו לשביעות רצונכם.

הפרות של זכויותיכם והליך הסרה

  • אנו מכבדים את זכויות הקניין הרוחני של אחרים.
    האתר כולל תכנים ויצירות שונות (מוגנים או לא). אם היצירות המוגנות בזכויות היוצרים שלכם נעשה בהן שימוש שלא כהלכה על ידי מי מהמשתמשים או האמנים שלנו, באתר, אנא הודיעו לנו וספקו לנו את כל המידע הרלוונטי (באמצעות דוא"ל זה: support@funzy.world) כדי שנוכל לטפל בכך בהתאם לכל דין רלוונטי.

כתבי ויתור ואי אחריות של האתר

  • אין אחריות מכל סוג שהוא. האתר וכל חלק מהשירותים מסופקים על בסיס "כמות שהם" ו"כפי שזמינים" וכפי שזמינים. האתר וכל מי שקשור אליו או פועל מטעמו מתנערים במפורש מכל אחריות, תנאי או מצג מכל סוג שהוא (מפורש, משתמע, בעל פה או בכתב), לרבות אך לא רק התאמה למטרה מסוימת, פונקציה ספציפית, פונקציונליות, סחירות, אמינות, זמינות, איכות, ביצועים, אי הפרה, הנאה או אחר. האתר אינו יכול להבטיח ואינו מבטיח תוצאות ספציפיות כלשהן מהשימוש באתר או בשירות.

  • תחומי שיפוט מסוימים מספקים אחריות מסוימת. במידה המרבית המותרת על פי חוק, אנו שוללים את כל האחריות כאמור, אלא אם היא חובה על פי תחום שיפוט ספציפי.

  • אין אחריות . בשום מקרה האתר, הדירקטורים, העובדים, הסוכנים שלו או כל מי מטעמו לא יהיו אחראים לכל משתמש או צד שלישי בגין נזקים ישירים ועקיפים, תוצאתיים, לדוגמה, מקריים, מיוחדים או עונשיים, לרבות בגין אובדן רווחים, הכנסות או נתונים, הפסד כספי או כל סוג אחר של נזקים הנובעים מהשימוש באתר או בכל אחד מהשירותים, התוכן (כולל תוכן של אמנים), האינטראקציה או כל אחד מהאתר או השירות או תוכן אחר, שאליו ניגשו או הורדו מהאתר או נמסרו מטעם מי מהאמנים, גם אם האתר מודע או הוזהר לגבי האפשרות של נזקים כאמור.

  • הגבלת אחריות. מכיוון שתחומי שיפוט מסוימים אינם מאפשרים הגבלה מלאה של אחריות כאמור לעיל, או בכל מקרה שבית משפט מוסמך כלשהו יחליט כי מסיבה כלשהי האתר או כל מי מטעמו יהיו אחראים לכל נזק מכל סוג שהוא, האחריות הכוללת של האתר (או כל מי מטעמו) בגין נזקים (ישירים ועקיפים), תביעות או עילות מכל סוג שהוא (בין אם חוזיות, נזיקיות או אחרות), בין אם על פי חוק, עקב תנאים אלה (כולל אחריות משתמעת מכל סוג שהוא) ומכל סיבה אחרת תהיה מוגבלת (במידה המרבית המותרת על פי חוק) ולא גבוהה מהסכום ששילמתם לאתר כדי להשתמש בשירות או בצלמית הרלוונטיים הספציפיים שלו כפי שניתן, לתקופה של 6 החודשים האחרונים לפני קרות הנזק. בכל המקרים, האתר וכל מי מטעמו לא יהיו אחראים לכל אובדן או נזק שאינו צפוי באופן סביר.

  • אין אחריות לפעילות או ברירת מחדל, מחדל או רשלנות של אמנים. האמנים וכל מי מטעמם פועלים באופן עצמאי וללא פיקוח של האתר. לכן, האחריות הבלעדית לכל פעולה, מחדל, רשלנות, הפרת חוזה או כל הפרת חוק שלהם, תהיה שלהם בלבד והאתר לעולם לא יישא באחריות למקרים כאמור.
  • אין אחריות לכל שגיאה מכל סוג שהוא. האתר עשוי לכלול ואינו נוטל אחריות לכל שגיאה, השמטה, הפרעה, מחיקה, פגם, עיכוב בפעולה או שידור, כשל בתקשורת, גניבה או הרס או גישה לא מורשית, או שינוי של כל דבר בתוך האתר.

  • אין אחריות להפרות אבטחה, תוכנות זדוניות, הונאה או תקלות דומות. כמו תמיד באינטרנט, ולמרות שהאתר נוקט באמצעי אבטחה סבירים כמקובל, הפרות אבטחה מסוימות, פריצות, סדקים, הונאה או תקלות אחרות (כגון וירוסים וקודי סוס טרויאני) עשויות תמיד לקרות. לא נישא באחריות לכל תקלה כאמור.

  • אין אחריות לפרסומות.  האתר אינו נוטל אחריות לפרסומות של צדדים שלישיים (כולל של אמנים) המתפרסמות באתר, ואינו נוטל אחריות למוצרים או לשירותים המסופקים על ידי המפרסמים שלו או לכל אחריות או התחייבות המפורטות בפרסומת כאמור.

יישוב סכסוכים

  • דין ושיפוט בלעדיים.  על ידי שימוש באתר (כולל כל אפליקציה או אחרת) או בכל אחד משירותיו בכל דרך שהיא, אתם מסכימים כי כל מחלוקת בנוגע לאתר, למוצריו או לשירותיו או הכרוכה בו תהיה כפופה באופן בלעדי לחוקי מדינת ישראל, ללא התחשבות בהוראות ברירת הדין וכפופה לתנאים אלה. במקרה כזה, אתם מסכימים לשיפוט אישי ומקום התדיינות בלעדיים בבתי המשפט המוסמכים במחוז תל אביב, ישראל.

  • תשפו ותגנו על האתר, חברות הבת והשותפים שלו, והדירקטורים, הפקידים, הסוכנים, השותפים, הקבלנים והעובדים המתאימים שלהם, מפני כל הפסד, חבות, תביעה, דרישה, עלויות, נזקים או הוצאות, לרבות שכר טרחת עורכי דין סביר, שנגרמו על ידי צד שלישי כלשהו עקב או הנובעים מהשימוש באתר או בשירות או בכל אחד מהתכנים, תוך הפרה של תנאים אלה ו/או הנובעים מהפרה של תנאים אלה ו/או כל הפרה של הצהרות והתחייבויות שלכם המפורטות לעיל ו/או אם תוכן כלשהו שאתם מפרסמים באתר או בשירות גורם לאתר להיות אחראי לצד שלישי כלשהו.

מבצעי קידום, פרסים והטבות

  1. כללי

Funzy רשאית מעת לעת לקיים מבצעי תגמול, הטבות, פרסים ופעילויות אינטראקטיביות למשתמשים במסגרת אירועים חיים, הופעות, אירועי ספורט או פעילויות מיוחדות אחרות (להלן: "המבצע"). ההשתתפות במבצע הינה וולונטרית וכפופה לתנאים אלו.

  1. זכאות להשתתפות

ההשתתפות במבצע פתוחה למשתמשים רשומים באפליקציית Funzy העומדים בתנאי הזכאות כפי שיפורסמו ביחס לכל מבצע. Funzy רשאית לקבוע תנאים נוספים, לרבות דרישות גיל, מיקום גיאוגרפי, נוכחות באירוע, חלון זמן להשתתפות או כל תנאי אחר.

  1. ללא צורך ברכישה

ההשתתפות במבצע אינה כרוכה בתשלום, הימור, רכישה או כל תמורה כספית אחרת.

  1. חלוקת פרסים והטבות

הפרסים וההטבות מחולקים באמצעות מערכת אוטומטית של Funzy. סוגי הפרסים, הכמויות, שיעורי הזכייה, אופן החלוקה ותנאי המימוש עשויים להשתנות ממבצע למבצע ועל פי שיקול דעתה הבלעדי של Funzy.

  1. סוגי פרסים

הפרסים עשויים לכלול הנחות, קופונים, כרטיסים, מוצרי מרצ'נדייז, פריטי אספנות, חוויות מיוחדות, תכנים דיגיטליים, מוצרים פיזיים או הטבות אחרות. אלא אם צוין אחרת במפורש, לפרסים אין ערך כספי ולא ניתן להמירם למזומן.

  1. השתתפות אחת למשתמש

אלא אם צוין אחרת, כל משתמש זכאי להשתתף פעם אחת בלבד בכל מבצע. Funzy רשאית לפסול השתתפות כפולה, חשבונות כפולים או כל ניסיון לעקוף מגבלה זו. במקרה של חשד לשימוש במספרי כרטיס שאינם שייכים למשתתף אשר הובילו לזכיות מרובות, החברה רשאית להגביל את הזכייה לכדי פריט אחד לכל היותר או אף לפסול את השתתפותו בגלל החשד לרמייה.

  1. מניעת הונאות

Funzy שומרת לעצמה את הזכות לאמת את זכאות המשתתף, את נוכחותו באירוע ואת תקינות ההשתתפות. Funzy רשאית לפסול כל משתמש אשר קיים חשד סביר כי פעל במרמה, באמצעות אוטומציה, חשבונות כפולים או בניגוד לתנאי השימוש. Funzy רשאית לאמת את זכאות המשתתף באמצעות מספר כרטיס, מספר הזמנה, נתוני נוכחות באירוע, נתוני מיקום או מידע אחר המתקבל ממפעיל האירוע, מערכת הכרטוס או שותפים מורשים לצורך אימות ההשתתפות במבצע. משתמש שלא ניתן יהיה לאמת את זכאותו, או אשר מסר מידע שגוי, מטעה או חלקי, לא יהיה זכאי לקבלת פרס או הטבה במסגרת המבצע.

  1. איסוף ומימוש פרסים

Funzy רשאית, לפי שיקול דעתה הבלעדי, לקבוע כי פרסים מסוימים יחולקו במועד, במקום או במסגרת אירוע ייעודי שייקבעו על ידה או על ידי חברת ליאם הפקות. הזוכים יקבלו הודעה מראש על אופן, מועד ומיקום קבלת הפרס. השתתפות באירוע החלוקה או הגעה לנקודת האיסוף שנקבעה עשויות להוות תנאי לקבלת הפרס. במקרה של אי-הגעה או אי-מימוש הפרס בתוך התקופת הזמן שתיקבע על ידי Funzy, החברה תהיה רשאית לבטל את הזכאות לפרס או לקבוע אופן חלוקה חלופי, לפי שיקול דעתה.

  1. שינוי או ביטול המבצע

Funzy רשאית לשנות, לעדכן, להפסיק, לבטל או להחליף כל מבצע, פרס או מנגנון השתתפות בכל עת, מכל סיבה עסקית, טכנית, משפטית או תפעולית.

  1. הגבלת אחריות

Funzy לא תישא באחריות לתקלות טכניות, בעיות תקשורת, כשלים במכשירי המשתמש, עומסי מערכת או כל נסיבה אחרת שאינה בשליטתה הסבירה ואשר עשויה להשפיע על ההשתתפות במבצע.

  1. אופי המבצע

המבצע הינו פעילות שיווקית לקידום מעורבות אוהדים ואינו כרוך בתשלום, הימור או סיכון כספי מצד המשתתפים..

12. ניהול המבצע

המבצע מנוהל ומופעל על ידי Funzy ושותפיה בלבד. Apple Inc., Google LLC וחברות קשורות להן אינן נותנות חסות למבצע, אינן מעורבות בו ואינן אחראיות לו בכל צורה שהיא.

  1. פרטיות ומספר טלפון

Funzy רשאית לדרוש אימות מספר טלפון, חשבון משתמש, כרטיס כניסה או פרטי זיהוי נוספים לצורך אימות זכאות, מניעת הונאות ומסירת פרסים.

אחר

  • הגבלת תקופת ההתיישנות. אתם מסכימים בזאת כי כל תביעה או עילת תביעה מכל סוג שהוא נגד האתר או כל מי מטעמו יוגשו לבית משפט תוך ולא יאוחר מעשרים וארבעה (24) חודשים לאחר תאריך התרחשותה. סעיף זה ייחשב כהגבלה מוסכמת על תקופת ההתיישנות על פי כל דין רלוונטי, ויגבר על כל דרישה משפטית אחרת (אלא אם מדובר בדרישה משפטית מחייבת).

  • הסכם מלא.  תנאים אלה (הכוללים את מדיניות הפרטיות של האתר וכל הודעות אחרות המתפרסמות באתר) מהווים את ההסכם המלא ביניכם לבין האתר בנוגע לכל סוג של שימוש באתר.

  • אי ויתור על זכויות. כישלון של האתר לממש או לאכוף כל זכות או הוראה מתנאים אלה לא יהווה ויתור על זכות או הוראה כאמור.

  • כותרות הסעיפים לנוחות בלבד. כותרות הסעיפים בתנאים אלה נועדו לנוחות בלבד ואין להן תוקף משפטי או חוזי.

  • התנאים פועלים במידה המרבית המותרת על פי חוק. אם הוראה כלשהי מתנאים אלה אינה חוקית, בטלה או בלתי ניתנת לאכיפה, הוראה זו תיחשב כניתנת להפרדה מתנאים אלה ולא תשפיע על התוקף והאכיפות של שאר ההוראות.

  • אין הסכם צד שלישי. אתם מסכימים כי, למעט כפי שצוין במפורש אחרת בתנאים אלה, לא יהיו צדדים שלישיים מוטבים מתנאים אלה.

Welcome to Funzy World, your online home for superfans where celebs and their fans can interact in the most innovative way. 

We are happy to be your platform that connects you and other fans with artists, performers, social media icons and various celebrities ("Artists") so you can interact using the Site or directly with them. 

PLEASE READ ALL OF THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN IMPORTANT LEGAL INFORMATION REGARDING YOUR RIGHTS, DUTIES, SCOPE OF REMEDIES, ETC., WHICH YOU WILL BE BOUND BY AS A LEGAL AGREEMENT.

ANY USE OF ANY KIND OF THE SITE, ANY APPLICATION, ANY FIGURINEOR OTHER MERCHANDISE OR ANY OF THEIR SERVICES (INCLUDING CREATING CELEBRITY INTERACTIONS OF SORTS) SHALL CONSTITUTE AN AGREEMENT TO THESE TERMS. PLEASE DO NOT MAKE ANY OF THE ABOVE UNLESS YOU AGREE TO THE TERMS AS DEFINED HEREIN.

In these Terms, "the Site" (also referred to as "we," "us," or "our") encompasses the website located at https://funzy.world, any related applications—including but not limited to the Funzy App and the Funzy – Eyal Golan App—and all associated services. This definition also includes, where applicable, the owners of the Site, its managing entities, operators, directors, employees, shareholders, affiliates, and any authorized representatives.

Modifications to the Terms. You should check the Terms (as defined below) periodically for modifications. We may modify the Terms from time to time without notice. If We make material changes to the Terms, we will post the revised Terms and the effective date thereof on the Site or notify you by e-mail, but we may not do so at our own discretion. Any continued use by you of the Site (including any of the Apps or their Services) after the posting of such modified Terms shall be deemed to indicate your explicit agreement to such modified Terms. Accordingly, if at any time you do not agree to be subject to any modified Terms, you should no longer use the Service or the Site.

Our Purpose

  • Our Site and services are designed to allow you and other fans to follow your favorite Artists, interact with them, receive various content and products from them, participate in their off-line and online activities, etc. Therefor we supply Artists you chose to follow with various data and information about you about you and try to allow open, direct and enjoyable interactions and connections between the Artists and yourself.
  • After such interaction has started, the Artists and you may interact through the Site or off the Site, all as you may chose fit. We do not take any part of such interaction, unless otherwise specifically stated on the Site.

Term and validity

  • The Terms. These Terms, the Privacy Policy https://www.funzy.world/privacy-policy of the Site and any other policy, guidelines or terms published by the Site or applying to any application, service, order or purchase, together or separately, as relevant, hereby - the "Terms". 
  • The Terms shall remain in full power at any time as long as they are relevant. Terminating your account does not terminate the applicability of the Terms to you.
  • Use of the Site by Persons Under 16 Years of Age is prohibited:  Accordingly, children under the age of 16 may not use the Site for purchases, and if done so – their use may be prohibited and limited with no prior notice.

Registration to the Site 

  • Our services may or may not be free. We may, at any time and regarding any service or product, decide whether such service or product is free of charge or is not free of charge. Such a decision may change from time to time.
  • The Figurines and the interactions. We may use (sell) figurines or other artifacts (any and all of them hereunder - the "Figurines") to allow you direct and quick enrollment to the Site. Their sole purpose is to allow more direct interaction between you and your favorite celeb-persons, Artists. You may use such Figurines to receive personal or other content and interact with your favorite Artists. Some of the Artists' content and offers may be public and other personally suited to their fans or to you specifically. The Artists themselves are the ones managing their relationships, and the Site is simply a platform to allow those interactions (and does not control them).
  • Registration to the Site.  To follow an Artist, accept and view her content or interact with her and her team, you may be required to use the "Celeb Figurine" you have achieved and open your own account. You may connect various Figurines to your account, one per each Artist you may want to follow and interact with. 

To remove any doubt, on various occasions registration to the Site will be allowed without using a Figurine (or for example by using a relevant code instead), yet all the Terms herein apply to such registration as well. Following an Artist will be made directly by your own choice, in such instances.

  • Upon registration you will be requested to choose a unique username and a personal password (which shall remain encrypted and will not be available to us). You may also be requested to enter various data to be used by us while managing your enjoyment from the Site and shared with various Artists you follow. Upon registering your account, you agree -
  1. That you understand that everything you upload or share to your account may be shared with the Site and the relevant Artists you may follow and their staff. Anything you post in any public forum may be viewed by any user of the Site;
  2. That supplying any such information is not mandatory, is pursuant to your own agreement and wishes, and that the Site and Artists may use any such information to promote the Site, The Artist or your interactions with them;
  3. that the information you provide the Site or Artists with will be current, complete and accurate;
  4. that you will not take any screenshots or other recordings of materials and content and Works you accept from the Site. Such content and Works may be copyright protected and you hold the non-exclusive and revocable license to privately view each such content and Work.  No other use is licensed. Any un-licensed use of any content or Work (either from the Site or from the Artists directly) shall result in automatic termination of your license.
  5. not to transfer, sell, convey or assign the right to use your account to any third party; 
  6. not to permit any third party to use your username and password or your Figurine in order to access your account. You further agree that you are responsible for the conduct of any party that uses your account or Figurine, whether or not authorized by you, and for any breach of security related thereto.

Funzy reserves the right to verify user eligibility and event attendance and to disqualify any participant suspected of fraud, manipulation, abuse, unauthorized account creation, use of automated tools, or violation of these Terms.

  • Any activity in your account, Figurine and your details is your own responsibility. Please check carefully any details you submit to the Site, as the Site will act based on them. Wrong, outdated, incomplete or otherwise incorrect information might cause undesirable results. Also, use of your Figurine by third party may harm your privacy, your enjoyment from the Site or the interaction with the Artists you choose to follow. You are requested to keep your password, Figurine and any other private data as confidential, as you will be the sole liable for anything occurring within your account, even if not executed by yourself.
  • Registration may be denied. The Site reserves the right, but is under no duty or representation, to review any and each of the registration requests, and deny any of such requests subject to its own discretion and with no explanation or notice supplied. If you do not agree, please do not register to the Site. In some instances, the Site might not allow any registration or specific purchase based on its sole discretion and with no explanation supplied. You shall have no complaint or claim against the Site in such a case. 
  • Grant of Rights. Upon registering (and subject to an accepted or proper use of the Figurine and the Site's interface) the Site grants you a limited, revocable, non-transferable, non-exclusive right to access and use the Site, if such activity is solely for your personal purposes.
  • Password and Figurine are and must be kept private. It is your responsibility to keep your password and your Figurine private and confidential (as relevant). Any use or misuse of the password or of your Figurine shall be your responsibility alone. 

If you suspect unauthorized use of your Account, PLEASE notify us immediately (at our "contact us" page https://www.funzy.world/contact (subject: Unauthorized use of my account), and supply us with enough information both to base your suspicion and your ownership of the Account as per our discretion. Also please change your password immediately.

Use of the Site and the Figurine

  • Use of the Figurine. Each Figurine you may get is embedded with NFC component that the Site (including its App.) may recognize and allocate directly with your own personal account. Such use may make it easier for you to register to the Site or to specific Artists.
  • Use of the Site. Once you use the Figurine and open an account, the Site will use each Artist's relevant Figurine as an indication you wish to follow that Artist, to accept and enjoy material such Artist posts on the Site, read relevant posts, view relevant video clips, participate in quizzes, sign up to various shows and performances and be exposed to any activity the relevant Artist may allow on the Site. Due to our main purpose, we supply each Artist you may follow with the information you upload to the Site, or the Site had collected about you, as may be relevant.

The Site may allow you various activities, content and interactions, such as (but not limited to) writing on various forums, receiving various content and offers, watching special videos and taking part in unique activities the Artists create.

  • The License granted to you. We hereby grant you a nonexclusive, nontransferable license (limited by the Terms) to access and use the Site in accordance with normal use of its interface. To remove any doubt, the use of the Site is licensed, not sold. 
  • You may not: To the extent permissible by applicable law, you may not, nor may not permit any other person or entity to:
    • Make available to the public, transmit, perform or otherwise distribute in any manner (commercially or privately, for pay or for free) any content or Works either on the Site or delivered to you on behalf of any of the Artists;
    • Sublicense, redistribute or lease any portion of the Site, your account therein or any content included on the Site or supplied by any Artist;
    • Reverse engineer, decompile, disassemble, modify, translate, make any attempt to discover the source code of the Site or create derivative works from any of the Services or surveys;
    • Reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any use of or access to the Site; or
    • Copy, reproduce, capture, store, retransmit, distribute or otherwise make any use not in accordance with the Site's interface or while removing the Site's logo, of any content included within.
  • Conduct prohibited. The following is a non-inclusive list of the kinds of conduct that is forbidden on the Site, including conduct that is - 
  1. Illegal or unauthorized use of the Site, including but not limited to intellectual property breach, and any other illegal, breaching, damaging, harmful or inappropriate activity;
  2. harassing, stalking or advocating harassment or stalking of another person or group of individuals;
  3. solicits passwords or other personal information (such as addresses, social security numbers, etc.) from other users;
  4. attempting to impersonate another person or opening an Account under false name, characteristics or pretences;
  5. using the account, username, Figurine or password of another at any time or disclosing your password to any third party or permitting any third party to access your account or your Figurine;
  6. accessing data or code that is not intended for the users of the Site, or gaining unauthorized access to an account, Figurine, server or any other computer system;
  7. attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures;
  8. any automated use of or access to the Site (or any code or Figurine), including but not limited "bots", "robots", "spiders", etc. that accesses the Site in a manner that sends request messages to the Site's servers more than a human can reasonably produce in the same period of time by using a conventional on-line web browser. 
  9. attempting or interfering with the function of the Site, Service, host or network, including, without limitation, via means of submitting a virus to the Site or its users, overloading, "flooding", "mailbombing", "crashing", "ddos attacks", "malware" or sending unsolicited e-mail, including promotions and/or advertising of products or Service;
  10. circumventing, disabling or otherwise interfering with security-related features or other digital-rights-management features of the Site.

  • You may not alter or modify in any way or manner any part of the Site, its look-and-feel, interface, advertisements, code, printouts, content, Works included or any of its related technologies or the surveys within.
  • To remove any doubt, we do not undertake to keep ay back-up or allow free and continuous access to any content or Work contained on the Site or supplied by the Artists (including tickets for shows). You are kindly requested to download or keep a copy for any such content you do not wish to lose (except protected Works, to which you can act as in accordance with the law).

Proprietary Rights and Intellectual Property

  • Copyright of the Site. The Site is and includes copyright protected works and protected trademarks. You may not modify, distribute, copy, frame, republish, display, post, publish, reproduce, sell or make any other use in any way of any content or part of the Site or any trademark therein.  
  • Artists' Works and content and limitation of license. The Site may include, or you may receive or be exposed to, various content and protected works (herein: "Works"). The copyrights in said Works are held by third parties, such as Artists or various others. You will receive access to said Works as a valued member of the Site or holder of a relevant Figurine. Nevertheless, we wish to specifically state that such access grants only limited, non exclusive, revocable license and you may not make any use of said Works except personal enjoyment.

Artists Content, Works and interactions

  • Information will be shared with Artists. The main purpose of the Site is to allow direct connectivity and interactions directly between you, selected Artists and their staff. For that reason, all information supplied to us may be shared with your selected Artist as well.
  • Artists use the information without the Site's control. It is specifically agreed that once your information is supplied to any Artist and her staff, any use of such information, and any activity of, or interaction with, such Artist is not controlled by the Site. Sole responsibility and liability relating to any such activity is solely by the hands of the relevant Artist or anyone acting on his behalf.

User Generated Content

  • User Content. You represent and undertake that you own all rights in and to any content (like messages, photo, video, text and other content or works) uploaded by you to the Site or its services, including any designs, images, animations, videos, audio files, fonts, logos, illustrations, compositions, artworks, interfaces, text, literary works, musical works and any other materials (“User Content”), or otherwise have (and will continue to have) the full power, title, licenses, consents and authority, in and to your User Content, as necessary to legally use, publish, transfer or license any and all rights and interests in and to such User Content.
  • The User Content is (and will continue to be) true, current, accurate, non-infringing upon any third party rights, and in no way unlawful for you to possess, post, transmit or display.
  • We do not undertake to review and scan such User Content and you hold the sole responsibility to any such User Content. 
  • You have obtained all consents and permissions required under all applicable laws, regarding the posting, transmission and publication of any personal information and/or image or likeness of any person, entity or property which is part of the User Content, and you will adhere to all laws applicable thereto.
  • You further allow the Site and anyone on its behalf free, unlimited, non-exclusive license to use any such User Content on the Site, by the Artist or for the distribution and marketing of the Site.

Termination

  • Termination of specific accounts. The Site may terminate any account or membership, delete any profile and/or prohibit any user from using or accessing the Site or any purchase within, in whole or any part thereof, for any reason, for no reason, at any time in its sole discretion, with or without notice. 
  • Termination of the Site or any of its Services. The Site may also terminate its operations, all or any part thereof (including any of its services or Figurines), permanently or temporarily at its own discretion. The Site does not issue any warranty for continuance of any or all services or products and may terminate any or all of them at its own discretion, without notice and at any time. 
  • No remedies upon termination. To remove any doubt, you will not be awarded any remedy of any kind if the Site has terminated your account, your Figurine, any of its Services or its activity altogether and you have no claim against the Site in any of these cases.

Credit Cards and other Payment Methods

  • Any payment to the Site or to any of the Artists within the Site, is made by and to third parties payment processing services (such as Apple or Google payments, etc.). Before proceeding to check out please review their individual privacy policies (as appearing next to the payment box), their payment conditions and their payment methods. Please never use one which you do not feel comfortable or agree with. We (the Site) will not be responsible for the actions and policies of such third parties.
  • Your credit card details are not shared with us. 
  • Please be sure to provide your exact details of payment method and your exact billing address and telephone number (i.e. the address and phone number your credit card bank has on file for you). Incorrect information will cause a delay in processing your order and might not allow us to process it to your satisfaction.

Breaches of you rights and Take-Down Procedure

  • We respect the intellectual property rights of others.

The Site includes various content and Works (protected or not). If your copyrighted works were used inappropriately by any of our users or Artists, on the Site, please let us know and provide us with all the relevant information (using this email: support@funzy.world) so we can deal with it in accordance to any relevant law.

Disclaimers and no liability of the Site

  • We are not the manufacturers of products sold on our Site or by the Artists and not the creators of any content or Work (unless otherwise specifically stated). Therefore, when we have no knowledge of the terms of each interaction or transaction, and we are not liable to anything related thereto.
  • USE THE SITE AT YOUR SOLE RISK. YOU AGREE THAT THE USE OF THE SITE, ANY OF ITS SERVICES AND ANY INTERACTION WITH ANY OF THE ARTISTS SHALL BE AT YOUR SOLE RISK, TO THE FULLEST EXTENT PERMITTED BY LAW.
  • NO WARRANTEES OF ANY KIND. THE SITE AND ANY PART OF THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND AS AVAILABLE. THE SITE AND ANYONE RELATED TO IT OR ACTING ON ITS BEHALF EXPRESSLY DISCLAIMS ANY WARRANTY, CONDITION OR REPRESENTATION OF ANY KIND (EXPRESS, IMPLIED, ORAL OR WRITTEN), INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, SPECIFIC FUNCTION, FUNCTIONALITY, MERCHANTABILITY, RELIABILITY, AVAILABILITY, QUALITY, PERFORMANCE, NON-INFRINGEMENT, ENJOYMENT, OR OTHER. THE SITE CANNOT GUARANTEE AND DOES NOT PROMISE ANY SPECIFIC RESULTS FROM USE OF THE SITE OR THE SERVICE.

  • LIMITATION OF LIABILITY. AS CERTAIN JURISDICTIONS DO NOT ALLOW COMPLETE LIMITATION OF LIABILITY AS ABOVE, OR IN ANY CASE ANY COMPETANT COURT DECIDES THAT FOR ANY REASON THE SITE OR ANYONE ON ITS BEHALF SHALL BE LIABLE TO ANY DAMAGES OF ANY KIND, THE SITE'S (OR ANYONE ON ITS BEHALF) TOTAL LIABILITY DUE TO ANY DAMAGES (DIRECT AND INDIRECT), CLAIMS OR CAUSES OF ANY SORT OR KIND (WHETHER CONTRACTUAL, TORTIOUS OR OTHER), EITHER BY LAW, DUE TO THESE TERMS (INCLUDING IMPLIED WARRANTEES OF ANY KIND) AND FOR ANY OTHER CAUSE WILL BE LIMITED (TO THE EXTENT PERMITTED BY LAW) AND NOT HIGHER THAN THE AMOUNT YOU PAID TO THE SITE TO USE ITS SPECIFIC RELEVANT SERVICE OR FIGURINE AS APPILACBLE, FOR THE PERIOD OF THE PAST 6 MONTHS PRIOR TO THE DAMAGE OCCURANCE.

IN ALL CASES, THE SITE AND ANYONE ON ITS BEHALF WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE THAT IS NOT REASONABLY FORESEEABLE.

  • No liability to Artists' activity or default, omission or negligence. The Artists and anyone on their behalf act independently and under no supervision of the Site. Therefore, the sole liability to any of their action, omissions, negligence, contract breach or any breach of law, shall be solely theirs and the Site shall never be held liable for any such instances.
  • No liability to any error of any kind. The Site may include and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, anything within the Site. 
  • No responsibility for security breaches, malware, fraud or similar faults. As always online, and even though the Site undertakes reasonable security measures as customary, certain security breaches, hacks, cracks, deceit, fraud or other faults (such as viruses and Trojan horse codes) may always happen. We will be under no liability to any such fault.
  • No responsibility for linked materials and websites. The Site will contain links to other websites. The Site is not responsible for any content published on such other sites or opinions expressed on such other sites, including but not limited to their accuracy or their being kept up to date by such sites. Such sites are in no way investigated, monitored or verified for accuracy, completeness or otherwise by the Site.   • No responsibility for any technical difficulty. The Site will not be responsible for any problems or technical malfunction of any communication network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or players due to technical problems, virus and malicious codes or traffic congestion on the Internet or on any of the Service or combination thereof, including any injury or damage to yourself, to any user or to any person's computer related to or resulting from participation or downloading or receiving materials in connection with the Site. 
  • No responsibility to advertisements. The Site assumes no responsibility for third party advertisements (including Artists') which are posted on the Site, nor does it take any responsibility for the goods or services provided by its advertisers or to any warranty or undertaking detailed in such advertisement.

Disputes Resolution

  • Exclusive law and jurisdiction. By using the Site (including any application or otherwise) or any of its services in any manner, you agree that any dispute about or involving the Site, its products or its services shall be exclusively governed by the laws of the State of Israel, without regard to conflict of law provisions and governed by these Terms. In such a case, you agree to an exclusive personal jurisdiction and venue in the competent courts in the district of Tel Aviv, Israel.

Indemnification

  • You shall indemnify and hold the Site, its subsidiaries, and affiliates, and their respective directors, officers, agents, partners, contractors and employees, harmless from any loss, liability, claim, demand, costs, damages or expenses, including reasonable attorneys' fees, made by any third party due to or arising out of the use of the Site or the Service or any of the content, in violation of these Terms and/or arising from a breach of these Terms and/or any breach of your representations and warranties set forth above and/or if any content that you post on the Site or the Service causes the Site to be liable to any third party.

EVENT PROMOTION AND REWARDS

  1. Promotion Overview

Funzy may from time to time offer promotional fan engagement activities during live events, concerts, sporting events, or other special occasions (the "Promotion"). Participation is voluntary and subject to these Promotion Terms.

  1. Eligibility

Participation is available only to registered Funzy users who satisfy the eligibility requirements displayed within the App for the relevant Promotion. Additional eligibility restrictions, including event attendance, geographic location, age requirements, or participation windows, may apply.

  1. No Purchase Necessary

No purchase, payment, wager, or consideration is required to participate in the Promotion or to receive a reward. Participation in the Promotion is free of charge.

  1. Reward Allocation

Rewards are allocated automatically through Funzy's promotional system. Reward availability, quantities, probabilities, and distribution methods may vary between Promotions and may be modified, suspended, or discontinued at Funzy's sole discretion.

  1. Reward Types

Rewards may include discounts, promotional vouchers, merchandise, collectibles, event-related benefits, exclusive experiences, tickets, digital content, or other promotional items. Rewards have no cash value unless explicitly stated otherwise.

  1. One Participation Per User

Unless otherwise stated, each user is entitled to participate only once in each promotion. Funzy reserves the right to disqualify duplicate entries, multiple accounts, or any attempt to circumvent this limitation.

In cases where there is suspicion that ticket numbers not belonging to the participant have been used and have resulted in multiple wins, Funzy reserves the right to limit the participant's entitlement to a maximum of one prize or to disqualify the participant entirely due to suspected fraudulent activity.

  1. VFraud Prevention and Eligibility Verification

Funzy reserves the right to verify a participant's eligibility, attendance at the event, and compliance with the promotion rules. Funzy may disqualify any user where there is a reasonable suspicion of fraud, use of automated systems, multiple accounts, abuse, or any violation of these Terms.

Funzy may verify a participant's eligibility through ticket numbers, order numbers, event attendance records, location data, or other information obtained from the event organizer, ticketing provider, venue operator, or authorized partners for the purpose of validating participation in the promotion.

Any user whose eligibility cannot be verified, or who provides false, misleading, inaccurate, or incomplete information, may be disqualified and may not be entitled to receive any prize, reward, or benefit under the promotion.

  1. Reward Redemption

Funzy reserves the right, at its sole discretion, to determine that certain prizes will be distributed at a specific date, location, or as part of a dedicated event organized by Funzy or by Liam Productions.

Winners will be notified in advance regarding the method, date, time, and location for claiming their prize. Attendance at the designated distribution event or arrival at the specified collection point may be a condition for receiving the prize.

If a winner fails to attend, claim, or redeem the prize within the time period determined by Funzy, the company reserves the right to revoke the winner’s entitlement to the prize or to determine an alternative distribution method, at its sole discretion.

  1. Modification and Cancellation

Funzy reserves the right to modify, suspend, terminate, or replace any Promotion, reward, or participation mechanism at any time for operational, technical, legal, or commercial reasons.

  1. Limitation of Liability

Funzy shall not be responsible for technical malfunctions, connectivity issues, service interruptions, device incompatibilities, or any circumstances beyond its reasonable control that may affect participation in the Promotion.

  1. Promotional Nature

The Promotion is intended solely as a marketing and fan engagement activity. Participation is free of charge and does not involve any payment,  wagering, gambling or financial risk by participants.

  1. Promotion Management

    The Promotion is organized and administered solely by Funzy and its promotional partners. Apple Inc., Google LLC, and their respective affiliates, subsidiaries, and related entities do not sponsor, endorse, administer, operate, or assume any responsibility for this Promotion in any way.

  2. Phone Number and Identity Verification

Funzy may require verification of a participant's phone number, user account, event ticket, identity, or other relevant information for the purposes of eligibility verification, fraud prevention, reward fulfillment, and administration of the Promotion.

Other

  • Limitation on the Period of Limitation. YOU HEREBY AGREE THAT ALL CLAIM OR CAUSE OF ACTION OF ANY KIND VERSUS THE SITE OR ANYONE ON ITS BEHALF SHALL BE FILED IN A COURT OF LAW WITHIN AND NO LATER THAN TWENTY FOUR (24) MONTHS PAST THE DATE OF ITS OCCURRENCE. THIS SECTION IS TO BE CONSIDERED AS AN AGREED LIMITATION ON THE PERIOD OF LIMITATION UNDER ANY RELEVANT LAW, AND SHALL OVERCOME ANY OTHER LEGAL REQUIREMENT (UNLESS IT IS A MANDATORY LEGAL REQUIREMENT).
  • Entire agreement. These Terms (which include the Site's privacy policy and any other notifications posted on the Site) constitute the entire agreement between you and the Site regarding any kind of use of the Site. 
  • Non waiver of rights. Failure of the Site to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision. 
  • Section titles solely for convenience. The section titles in these Terms are for convenience only and have no legal or contractual effect. 
  • The Terms operate to the fullest extent permissible by law. If any provision of these Terms is unlawful, void or unenforceable, that provision is deemed severable from these Terms and does not affect the validity and enforceability of any remaining provisions.
  • No third party agreement. You agree that, except as otherwise expressly provided in these Terms, there shall be no third party beneficiaries to these Terms.
